Auction Plus+ Consignment Auction Terms and Conditions
- Equipment Representation and Warranties
1.1. All items sold through Auction Plus+ are provided without warranties, expressed or implied, in accordance with applicable laws, including the laws of the State of Illinois. This includes, but is not limited to, implied warranties of non-infringement, merchantability, condition, usability, fitness for a particular purpose, or brand identity and quality.
1.2. Auction Plus+ strives to represent equipment accurately but does not provide any warranties or guarantees regarding the equipment.
1.3. Descriptions, photos, and verbal information are provided as guidance. Auction Plus+ personnel are not professional photographers, and photos may not fully depict all aspects of items.
- Operational Assessment
2.1. Auction Plus+ does not conduct testing or operational assessments on items sold in its auctions.
2.2. Reported hours and miles are based on the meter at the time of listing and are not guaranteed to be accurate.
- Buyer Responsibility for Inspection
3.1. Buyers are responsible for inspecting items before bidding to assess operational condition and suitability for use.
3.2. Seller's representative’s information and item location will be provided in the listing description.
3.3. Buyers are advised to contact sellers, inspect items, and validate information prior to bidding.
3.4 There may be a scheduled viewing time for items located at a designated location. Check auction advertisements for the schedule time and place to view certain items. Location will say in the description of the item.
- Risk of Loss and Ownership
4.1. Buyers must arrange pickup or transportation of purchased items and must pay in full within forty-eight (48) hours of auction close, as required by these terms.
4.2. After winning the bid, the seller is responsible for maintaining items for fourteen (14) calendar days or until the buyer or their agent picks up the item, whichever comes first.
4.3. After the specified period, buyers assume full responsibility for items, including risks of loss due to various factors.
- Inspection, Verbal, and Written Statements
5.1. Auction Plus+ is not responsible for seller statements, whether verbal or written.
5.2. Buyers should validate all statements by inspecting items before bidding.
5.3. Failure to inspect an item is not grounds for dispute.
- Dispute Handling
6.1. Auction Plus+ will assist in resolving disputes to the best of its ability.
6.2. Disputes must be submitted in writing using an Auction Plus+ dispute form within 14 days of winning the item, in accordance with Illinois law.
6.3. Resolutions are ultimately the responsibility of the buyer and seller.
- Reserve Auction Terms
7.1. Auction Plus+ may offer items with reserve prices set by the seller. Item will not sell if the highest bid does not meet the reserve price unless authorized by the seller.
7.2. This is not an absolute auction. The seller reserves the right to reject any bid that has not met the pre-auction reserve price.
- Failure to Pay and Default
8.1. Buyers who fail to pay for items are subject to collection and may be charged liquidated damages.
8.2. Failure to Pay results in suspension from future auctions.
- Equipment Removal and Abandonment
9.1. Buyers must remove items within fourteen (14) calendar days of winning the bid.
9.2. Failure to remove items may incur storage fees and consequences as outlined in this section, in accordance with Illinois law.
9.3. Abandoned items may be resold or disposed of based on the sale price, as permitted by Illinois law.
- Tax and Licenses
10.1. Buyers are responsible for applicable sales tax and government licenses, as required by Illinois law.
10.2. Sales tax exemption forms must match the buyer's account details and must be submitted within the payment deadline.
- Registration and Bidding
11.1. Bidders must be 18 years of age or older and in compliance with Illinois law to participate.
11.2. Auction Plus+ reserves the right to remove bidders for non-compliance with its terms.
- Settlement and Payment
12.1. Successful bidders must make full payment within 48 hours after auction close or prior to 6:00 PM CST on the Friday of the auction week.
12.2. Various payment methods are accepted, with details provided on the invoice.
12.3. Payments may incur convenience fees, in compliance with Illinois law.
12.4. Credit card payments are accepted but not for amounts exceeding $2,500 or on vehicles. Payments for such items must be made by wire transfer or cashier's check.
- Bidding Platform Failure (Technical Problems)
13.1. In the event of technical problems, including but not limited to software malfunctions, server issues, or misbids, Auction Plus, LLC., the SELLER, or the software company providing the bidding platform, shall not be held responsible.
13.2. Auction Plus+ reserves the right to pause, postpone, reschedule, or cancel bidding at any time without notice and at the discretion of the auctioneer.
13.3. In the event of a technical problem, all decisions made by Auction Plus, LLC. are final and non-negotiable.
- Miscellaneous
15.1. These terms are subject to the laws of the State of Illinois.
